$12.6 Million SDA Tax Bill

As stated in a previous post, Guam alleges that the SDA Church owes some $12,600,000 in back taxes for the operation of its ABC and for  its medical care.  In order to defeat this, the SDA denomination has filed two (2) lawsuits challenging this.   One is scheduled to go to trail on January 31, 2018 and the second is scheduled to go to trail on February 20, 2018.

In short, this is the current future schedule:

*  One pre-trial conference has already taken place.

* Three more pre-trial conferences are scheduled to take place.

* A 2-day trail is scheduled for February 13, 2018

NOTE:  The process of justice is long.  Yet, this one has probably proceeded fairly quickly.   :(

Yes, for several years they did not file tax returns.

Probably they still have not filed.  Although it is possible that the SDAs have agreed on some  points.  E.G.  Why should there be a disagreement the sale of food items?  That is one of the issues.  The sale of books is another issue that should be resolved easily.

The largest elephant in the room is that of the clinic/hospital.  It should have been organized as a non-profit organization and it was not so organized.    While it can still be reorganized as a non-profit organization, at this point in time that will be a complex procedure which will require a lot of billable attorney hours.

if it can be established that these businesses are indeed non profit, it seems there should not be a problem,  but to grasp for money is not something above the government.  it is beyond understanding that there has been such a lapse of responsibility to not have these businesses properly established at non profits.  is it because it is a third world country without much governmental jurisprudence?

I will leave it up for discussion here as to whether or not the U.S. is a third world country.  :)

In the beginning it is not hard to establish a company/business as  not-for profit.

However, once that business/company has been established it can be  very complex to change it to a non-profit company/business.   And, it can be a complex to change it the other way from a non-profit to a for profit company/business.

Such changes can involve dissolving the company/business, distribution of the assets and permission of the  government and other regulatory agencies.  

NOTE:   I once lived in a place where local hospitals underwent such a change due to changes in the health-care market.
